Kiwi Kapers Privacy Policy


Overview


We are IMMIAT (referred to in this document as "we", "us" or "our"), a developer and publisher of games that are made available via app stores including the Apple App Store and the Google Play Store. We recognise the importance of your privacy and understand the concerns surrounding the security of personal information. This privacy policy sets out how we collect, use, and disclose personal information and other non-personal information that we have gathered about you in relation to our game “Kiwi Kapers”, which includes the associated website.


By using our game, you acknowledge and consent to the terms of this privacy policy.


This policy will let you know:


  • What information (often referred to as ‘data’) is collected from you.
  • How your information is used.
  • With whom your information may be shared.
  • How you can access, update, or delete your information.


We will comply with all relevant and applicable legislative requirements, and, in the event of any inconsistency, the legislative requirements will override the provisions of this document.


Age limits


Our game and website are not aimed at children under 13 years of age. Nevertheless, we do acknowledge that our game may unintentionally appeal to children.


A neutral age gate and privacy screen are in place at the launch of the game. These are used to tailor the game to the user’s age group and protect children from inadvertently seeing inappropriate advertising. We do not permit behaviourally targeted advertising to children under the age of 13 years.


We do not collect any personally identifiable information within this initial screening part of our game, nor do we intentionally direct interest-based advertising to anyone under the age of 13 years.


What data do we collect?


Most of the information that we collect about you comes directly from you when you play our games or interact with third-party ads in our games. In general, the information we collect about you relates to the type of device you are using, information that helps us identify your device, and may include information that you submit to us when you voluntarily contact us. Besides that, we use third-party platforms for in-game advertising. The basis for collecting data is "legitimate interest" under GDPR (Global Data Protection Regulation) and "to support internal operations of the game" under COPPA (Children's Online Privacy Protection Act). Any data collected is done solely for internal uses that are reasonably and directly related to your relationship with us, in accordance with the California Consumer Privacy Act (CCPA).


The information that we may collect about you through the services broadly falls into the following categories:


1) Information that you provide voluntarily


Certain parts of our services may ask you to provide personal information voluntarily. For example, we will ask for certain information in order for you to submit inquiries to us, such as:


  • Your name, email address, or other details, that are necessary to process your enquiries.
  • Any information you submit to our support team via email.


The personal information that you are asked to provide and the reasons why you are asked to provide it, we will try to explain to you at the point we ask you to provide your personal information.


2) Information that we collect automatically


When you use our services, we may also collect certain information automatically from you and/or your device which may be considered personal information under applicable data protection laws, such as:


  • Data about your game progress and preferred settings.
  • Your IP address and device identifiers such as your Device ID and Advertising ID.
  • Your device type and the operating system that you use.
  • Your broad geographic location, e.g., country or city-level location, based on your IP address.


Advertising ID means Apple Identifier for Advertisers ("IDFA") on Apple and Google Advertising Identity ("GAID") on Android. These are unique identifiers for mobile devices that advertisers use for personalised advertising. They are consistent across all mobile applications and thus allow cross-app tracking. See below for how to control your personalised Ad settings on the different platforms.


Device identifier/information means device type, device model, device maker, device operating system and its language, or other technical data like screen size or processor, or combination of this data available from a device for a developer to check the device compatibility with a particular application.


3) Information we obtain from third-party sources


To operate and manage our services we need to use third-party service providers. A list of those parties can be found in this privacy policy. The type of information we might collect from them includes:


  • Data we receive if you link a third-party tool with the service, such as Google Play Games Service or Apple Game Center.
  • Demographic data (to determine the coarse location of your IP address).
  • Data from platforms that the games run on.
  • Data for advertising and analytics purposes.


How do we use the data that we collect?


We use the information we collect about you/your device to deliver services and our games to you and to operate our business. In addition, we use your information to display third-party advertisements to you. We use your information also for tracking and fraud prevention for advertising purposes and for complying with our legal obligations.


Data collected can be personal to you or non-personal, and sometimes data that doesn’t appear to be personal can become personal if certain other facts are learned. No matter how we come to collect your data, we will always treat it in accordance with this document, and any applicable legislation.


What is Personal Information?


'Personal Information' is information that identifies you as an individual. This is only collected by us if you submit it to us directly. We note that this does not mean that the game itself does not collect data, rather we do not collect personal information from you.


User Enquiries


If you contact us with a comment or query, we keep a copy of any personal information you provide. This is so that we can respond to your comments and questions as a part of our commitment to providing you with user support. If you contact us directly for any reason, we also keep a copy of that correspondence.


What about sensitive information?


Sensitive information includes information about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a professional body, criminal records, or health information. We will not attempt to obtain nor record any sensitive information.


Third-Party Service Providers


Apart from us, your data is accessible by our third-party providers in the following circumstances. Our game includes services from third-party providers such as functionalities through Application Programming Interfaces (APIs), Software Development Kits (SDKs), and in-app advertising. These third-party providers may access your data and operate under their own privacy policies. We encourage you to review their privacy policies (listed below) before interacting with our game.

Advertising


Advertisements from third-party ad networks are displayed in our games. All reasonable endeavours are used to ensure that these ad networks comply with all applicable legislation in the provision of their services to us. If you click on any advertisements through our game, the advertisers may use cookies and other web-tracking technologies to collect data, to provide targeted advertisements to you. Some of this may be personal information and some of it non-personal information. We recommend that you review the terms of use and privacy policy for any advertiser with whom you are interacting before doing so.


Google AdMob Privacy Policy

Google Ads SDK Apple App Store, Google Play


To enable us to show in-game ads, we may send your advertising ID and IP address to advertisers (or ad networks) to enable them to find appropriate ads to serve to you in our games. You can control and limit our use of your advertising ID in your device settings. We do not control which specific ads are shown in our games, it is controlled by ad networks.


Advertising IDs are used by the ad networks for a number of purposes including:


  • Limit the number of times you see the same ad.
  • Ensure they are dealing with humans with real devices and not 'automated' bots.
  • Serve you with advertisements likely to be relevant to you based on your advertising ID engagement with other brands and ads, also recorded using your advertising ID and using your general geographic area. Other brands buy advertisement placement via an ad network or ad exchange to advertise their products in our games. The ad network or ad exchange acts as an intermediary between the other game companies and us. In order for an ad network to charge the company buying the ad, clicks from the ad and potentially installs of other developers' applications and third-party apps are tracked. Views, clicks, and installs from ads are measured using Advertiser ID.
  • Keep track of what games you have used to market you similar kinds of games. IP address is typically used by advertisers to broadly see the general geographic area you are coming from for example country, state, and sometimes at the city level.


For our EAA-based users, we made sure that our advertising partners are fully compliant with the GDPR law. Before sharing any information with our advertising partners for the purposes of personalised advertising, we always ask for your consent, given when you choose to accept at the relevant button at the loading of the game. We allow our advertising partners to show personalised ads to you only if you have accepted in the relevant menu and so consented to the sharing of your personal information for the purposes of personalised advertising. Our advertising partners use different technologies for the purposes of personalised advertising that process your personal information in different ways, so please review their data processing practices before you accept to show you personalised ads at the loading of the game.


Turn off personalised ads


iOS


Open the "Settings" application of iOS and select the "Privacy & Security" menu item and then the "Apple Advertising" sub-item. In this menu, you can deactivate the "Personalised Ads" option.


How to reset your Apple Advertising ID


To reset your Advertising Identifier on iOS or iPadOS, go to Settings > Privacy & Security > Tracking, toggle "Allow Apps to Request to Track" off and then select "Ask Apps to Stop Tracking" in the prompt, then toggle "Allow Apps to Request to Track" back on. Please note, that once you have toggled "Allow Apps to Request to Track" back on, all of the apps you have previously given permission to track will now be toggled off, so you will need to toggle them back on individually if you would like to continue to give them permission to track.


Android


Open the "Settings" application and select the "Google" menu item. Select "Manage your Google Account", then select "Data and Privacy", scroll down to "Personalised Ads", select "My Ad Centre", and turn personalised ads off.


How to reset your Android Advertising ID


To reset your Android advertising ID, Open Google "Settings" on your Android device by tapping on menu and then on Google Settings once all apps are displayed on the screen. Locate and tap on the "Ads" menu under "Services". Tap on "Reset advertising ID" on the new page. Confirm the reset when the confirmation prompt is displayed.


In-App Purchases


Our games incorporates in-app purchases. We do not process payments for in-app purchases nor have access to your credit card information. Payment transactions for in-app purchases are completed through the app store via your App Store account or Google Play account. Any post-purchase processes are controlled by Apple and Google and are subject to specific terms of those Apple and Google stores. Please review the privacy policy and terms of service of your Apple and Google stores.



Third-party networks


Our games use third-party services such as Google Play Games Service and Apple Game Center. Such games enable you to log in to your account to connect to our games. Please note that these third-party networks are governed by their own privacy policies, terms, and end-user agreements and we are not responsible for, and have no control over, the sharing practices or policies of the third parties that operate those sites. If you use third-party networks to participate in game-related activities, such as leaderboards and multiplayer games, you share your information with other players and third-party networks (for example, scores, rankings, and achievements).


Data access & deletion


Regardless of how we come in contact with your data, you have the right to request access to any personal information we hold about you. You may request access to the information we hold about you by contacting us via email at info@kiwikapers.com.

How to update Privacy Consent

GO TO SETTINGS


Go to the Settings menu from within the game.


Note that you have an active internet connection to be able to update your privacy consent settings.


Click on the Privacy button and it will bring up a consent dashboard where you can update your preferences.
